Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your access to and use of the Alexandrie platform at alexandrie.world, operated by Komiyama & Co., a sole proprietorship (raison individuelle) registered in the Canton of Vaud, Switzerland ("we", "us", "Komiyama & Co."). By registering or using the platform you agree to these Terms in full.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Komiyama & Co. They may only be modified by us in writing (see Section 16). Nothing communicated by support staff, in email, or verbally modifies these Terms.

2. Eligibility

You must be at least 16 years old to use Alexandrie. By registering, you declare that you meet this requirement. Accounts found to belong to users under 16 will be terminated and their data deleted.

3. Your account

You are responsible for maintaining the confidentiality of your credentials. Accounts are personal and may not be shared, sold, or transferred. You may not create accounts for third parties without their knowledge. One account per person unless otherwise agreed in writing.

4. Acceptable use

You agree not to:

  • Scrape, crawl, or systematically extract content from Alexandrie by any automated means
  • Reverse-engineer, decompile, or attempt to extract our source code or trade secrets
  • Access or attempt to access accounts, data, or systems other than your own
  • Probe, scan, or test the security of the platform without our explicit prior written authorization
  • Use the platform while employed by or acting on behalf of a competing knowledge mapping, AI research, or mind-mapping platform for the purpose of competitive intelligence
  • Circumvent rate limits, account suspensions, or IP bans by any means including VPNs, proxies, or alternate accounts
  • Upload, generate, or share illegal, defamatory, or third-party infringing content
  • Use insights or data obtained from the platform to design, build, or improve a competing service
  • Use the platform for any purpose that violates Swiss law or applicable international law

This list is non-exhaustive. We reserve the right to determine what constitutes a violation at our sole discretion.

5. Content and licenses

Public content

By setting any map or knowledge to public visibility, you grant Komiyama & Co. a worldwide, royalty-free, sublicensable, transferable, perpetual, irrevocable license to use, display, reproduce, distribute, index, cache, adapt, and otherwise exploit that content in connection with the operation, promotion, and improvement of the service, including in marketing materials and for training internal AI systems.

This license also extends to authorized third-party applications accessing your public content through Komiyama & Co.'s official API, subject to the API Terms of Service. No other programmatic access to platform content is authorized.

Third parties have no license from us or from you to reproduce, scrape, redistribute, or train AI systems on platform content.

Private content

For content you keep private, you grant us a limited license to store, back up, process, and transmit it solely as necessary to provide the service. We may access private content when technically necessary for debugging, infrastructure maintenance, security investigation, or compliance with legal obligations.

Aggregated and anonymized data

We may extract, aggregate, and irreversibly anonymize usage patterns, content statistics, graph structures, and other non-identifying data derived from any content on the platform. This data may be used for any purpose without restriction, including research, product improvement, and commercial use.

Survival of licenses

The licenses you grant in this section survive account termination or deletion. Public content that was licensed at the time of deletion remains subject to the public content license in perpetuity.

6. Intellectual property of Komiyama & Co.

Platform and database rights

The Alexandrie platform — including its visual design, interface, information architecture, interaction patterns, and the selection and arrangement of content — is protected under Swiss copyright law (URG). Komiyama & Co. holds sui generis database producer rights over the structure and content of the platform.

Trade secrets

Our NLP pipeline, graph layout algorithms, relation inference logic, and scraping architecture are trade secrets of Komiyama & Co., protected under Swiss law and the Federal Act Against Unfair Competition (UWG). Reverse engineering or unauthorized disclosure is prohibited.

AI-generated content

Knowledge maps, summaries, and relation inferences generated by Alexandrie's AI systems are provided under a limited, non-exclusive, non-transferable license for your personal or organizational use within the platform. You may not claim authorship over these outputs or use them to train competing AI systems.

Trademarks

"Alexandrie" and all associated logos and interface elements are proprietary to Komiyama & Co. No license to use them is granted by these Terms.

7. Defensive patent license

By using the platform, you grant Komiyama & Co. a worldwide, royalty-free, non-exclusive, irrevocable license under any patent claim you hold or control that would be infringed by the normal operation of the Alexandrie platform as used by you. This license is granted solely as a defensive measure.

8. Your representations and indemnification

You represent and warrant that: (i) your content does not infringe any third-party rights; (ii) you have all rights necessary to grant the licenses in Section 5; and (iii) your use complies with all applicable laws.

You agree to indemnify and hold harmless Komiyama & Co. and its successors from any claims, damages, losses, costs, and legal fees arising from your content, your violation of these Terms, or your violation of any third-party rights.

9. API exclusivity

Only Komiyama & Co. may operate an API or programmatic interface that exposes Alexandrie platform data to third parties. Any other programmatic access — scraping, browser automation, unofficial libraries, or reverse-engineered calls — is unauthorized and constitutes a breach of these Terms.

Unauthorized programmatic access causes harm that is difficult to quantify. You agree that CHF 5 per unauthorized request is a reasonable pre-estimate of damages, which Komiyama & Co. may claim in addition to any other available remedies, without needing to prove specific loss.

10. Security and enforcement rights

Komiyama & Co. reserves the right at any time and without notice to: monitor platform traffic; rate-limit, throttle, or block any IP address or account; suspend or terminate any account pending or following investigation; require identity verification before restoring access; permanently ban accounts and IP ranges; access and preserve account data in connection with a security investigation; share preserved data with authorities pursuant to valid Swiss legal process; and initiate civil or criminal proceedings.

We retain sole discretion to determine what constitutes suspicious or unauthorized behavior, including vulnerability probing, port scanning, and any behavior consistent with unauthorized security testing.

11. Coordinated vulnerability disclosure

If you discover a security vulnerability in Alexandrie:

  1. Report it confidentially to contact@alexandrie.world with sufficient technical detail to reproduce the issue.
  2. If you receive no acknowledgment within 3 business days, send a follow-up to office@alexandrie.world.
  3. Do not disclose the vulnerability publicly until Komiyama & Co. has had a reasonable opportunity to investigate and remediate. We commit to acknowledging reports within 3 business days and providing a substantive response within 30 days.
  4. If remediation requires more than 120 days, we will communicate a revised timeline. Each revised timeline communication resets the disclosure window. If no remediation plan or revised timeline has been communicated within 120 days, you may disclose publicly after giving 14 days' prior written notice to office@alexandrie.world.
  5. Good faith safe harbor: Reports submitted in good faith will not give rise to legal action by us. Good faith means: (i) you did not exploit the vulnerability beyond what was minimally necessary to confirm its existence; (ii) you did not access, copy, or retain data beyond your own account; (iii) you reported promptly; and (iv) you did not disclose the existence of the vulnerability to any third party, security aggregator, CVE database, or public forum prior to receiving written authorization from us.
  6. Where discovery involved unauthorized access to systems or data beyond your own account, additional liability may arise independently under Art. 143bis of the Swiss Criminal Code.

12. Service availability

The platform is provided as-is and as-available. We make no guarantee of uptime, data persistence, or continued availability of any feature. We may modify, suspend, or discontinue any part of the service at any time, with or without notice. No SLA applies unless specified in a signed Sur-mesure contract. We may change infrastructure providers at any time without notice.

Pricing may be changed at any time. Existing paid subscribers will receive 30 days' email notice before a price change affects their active subscription.

13. Limitation of liability

To the maximum extent permitted by Swiss law, Komiyama & Co. is not liable for: loss or corruption of data; loss of profit or revenue; reputational damage; business interruption; or any indirect, special, punitive, or consequential damages, regardless of whether we were advised of the possibility of such damages.

Our total aggregate liability for any claim is capped at the amount you paid us in the 12 months preceding the claim, or CHF 100, whichever is greater.

We are not liable for failures of Supabase, Stripe, Cloudflare, Migadu, Hetzner, or any other third-party provider, nor for content posted by other users or the accuracy of third-party content sources.

14. No reliance

All content generated by Alexandrie (knowledge maps, summaries, relation inferences) is for informational and organizational purposes only. It does not constitute legal, medical, financial, or professional advice. You must not rely on platform output for critical decisions.

15. Force majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, pandemics, cyberattacks, DDoS attacks, governmental orders, Internet infrastructure failures, supply chain disruptions, or war.

16. Modifications

We may modify these Terms at any time by posting an updated version. Changes take effect upon posting. Continued use constitutes acceptance. Paid subscribers receive 30 days' email notice for material changes affecting their paid features. Failure to enforce any term on any occasion does not waive our right to enforce it in the future.

17. Account termination

We may suspend or terminate your account at any time, for any reason or no reason, with or without notice.

18. Export controls

You certify that you are not subject to any Swiss, EU, or international trade sanctions or export control restrictions, and that your use of the platform complies with all applicable export control laws.

19. Governing law and jurisdiction

These Terms are governed exclusively by Swiss law. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of the Canton of Vaud, Switzerland. Komiyama & Co. reserves the right to bring enforcement proceedings against users in any competent jurisdiction worldwide.

Any claim against Komiyama & Co. must be initiated within one year of the event giving rise to the claim.

20. General

Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Komiyama & Co., superseding all prior representations.

Severability: If any clause is found invalid, it shall be modified to the minimum extent necessary to be enforceable. All other clauses remain in full force.

No partnership: Use of the platform does not create any partnership, joint venture, employment, or agency relationship.

No third-party beneficiaries: These Terms do not confer rights on any third party.

Entity succession: All rights and obligations transfer automatically to any successor entity of Komiyama & Co. without requiring your consent.
